Terms & Conditions of Service

Acceptable Use Policy

All users of VMoHost DC (VMoHost) services must follow these acceptable use policies. VMoHost can change these policies at any time, and updates will be posted here. Users should regularly check the AUP to stay compliant with the latest version. Continuing to use the services after changes are made means you accept the new terms. Any complaints about AUP violations should be sent to support@vmohost.com.

Introduction

These Acceptable Use Policies define appropriate behavior when using VMoHost's services and describe potential actions VMoHost may take in response to misuse, with or without prior notice. These guidelines, which are designed to safeguard VMoHost's assets, guarantee excellent service, and uphold its reputation, are based on applicable laws and generally recognized Internet standards. Users are expected to follow these policies.

A. Security

  • You accept all risk when using our service. Any problems that could occur from using our platform are not our responsibility.

  • You are responsible for the files and data you transfer to our infrastructure. This includes making sure you have appropriate backups of all your files and data stored with us. Backup services are not included by default. Clients are responsible for their own data, and we strongly recommend purchasing our optional backup solutions for data protection.

  • You are accountable for all activities conducted through your account. This means you must keep your password secure, maintain confidentiality, and set the right file protections. We are not liable for any unauthorized access or usage of your account.

  • If your password is lost, stolen, or compromised, notify us immediately. We will suspend access or alter your account upon receiving your notification. However, we are not responsible for any usage or charges that occur before you notify us and we are able to make changes to your account.

  • While we work hard to make email as secure as possible, you should understand that no computer network is 100% immune to intrusion. Email can pass through multiple networks and should only be considered fully secure if encrypted. Even then, the level of security depends on the encryption method used.

  • Your rights to use an VMoHost account are limited to the named client on the Statement of Work (SOW). Accounts are non-transferrable and cannot be shared or used by anyone other than the named account holder.

B. Unacceptable Conduct

The actions listed below are considered unacceptable behavior by users. If these actions occur, VMoHost may suspend services immediately while investigating. This investigation could lead to termination of user accounts without refunds for any violations found. Users are accountable for the actions of their business associates and must stop any non-compliant actions promptly or sever ties with those individuals. If violations persist among a user's business associates, VMoHost may decide to terminate the user's account without issuing refunds.

Unacceptable Conduct includes, but is not limited to :

  • Spamming or Harassment: This includes posting excessively in newsgroups, sending mass emails without permission, or engaging in any abusive behavior online.

  • Unauthorized promotions: Doing things to promote a website hosted on VMoHost’s networks using methods that VMoHost hasn't approved, which could lead to abuse or harassment.

  • Intellectual property infringement: Sending or sharing copyrighted material, software, or proprietary information without the proper rights or permissions.

  • Network Unfriendly or Illegal Activity: Trying to access systems without permission, disrupting network operations, or breaking local, state, U.S., or international laws.

C. Export Control Violations

It is against the rules to export encryption software from the United States using the Internet or any other method.

D. Violation of the VMoHost Policy

  • It's not allowed to remove or bypass VMoHost’s identification on any page hosted on its servers.

  • Displaying, selling, or transferring materials that violate copyright, trademark, or proprietary rights is not allowed.

  • Operating accounts in connection with individuals or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) is not allowed.

E. Compliance with Other Networks' Rules

When accessing other networks connected to VMoHost’s services, you must adhere to the rules of those networks as well as VMoHost's own policies.

F. Monitoring and Privacy

VMoHost retains the right to monitor all communications passing through its facilities to ensure compliance with this Acceptable Use Policy (AUP) and VMoHost’s Terms and Conditions. Users should not expect their communications to be private.

G. Cooperation with Authorities

VMoHost collaborates with law enforcement to investigate illegal activities, such as the unauthorized transfer of materials, threats, or any other unlawful actions.

H. Confidentiality of Personal Subscriber Information

VMoHost does not disclose Personally Identifiable Information (PII) of users or clients unless a valid court order or legal obligation is presented. Users agree that VMoHost has the discretion to determine the validity of such requests.

I. KYC Verification & Customer Information Policy

Under our KYC (Know Your Customer) policy, customers are required to provide accurate and original information including full name, email address, phone number, residential address, country, and postal code. If fake or incorrect information is detected, the customer will be given one opportunity to submit correct details. Failure to provide valid information may result in account suspension or termination. Customers from all countries, including Russia, are welcome to use our services. For security and fraud prevention, orders placed while connected through VPN, proxy, or anonymizing services may be rejected. If a customer fails to complete KYC verification or provides false information, the account may be banned, payments may be frozen, and no refunds will be issued. VMoHost respects customer privacy and will not sell, share, or leak personal information, except when required by law

J. Official Refund & KYC Policy

KYC Compliance and Refund Eligibility:
All clients are required to complete our Mandatory Know Your Customer (KYC) verification process to maintain account security and service integrity.

Credit/Debit Card Payments (Visa/Mastercard/AMEX): In the event that a user fails to complete the required KYC verification or provides invalid documentation, payments made via Visa or Mastercard will be eligible for a refund. Please note that processing times may vary depending on your financial institution.

Cryptocurrency Payments (Bitcoin/USDT): Due to the decentralized and irreversible nature of blockchain transactions, all payments made via Bitcoin (BTC) or any other cryptocurrency are strictly non-refundable. By choosing to pay with cryptocurrency, you acknowledge that no refunds will be issued regardless of your KYC verification status.
